Terms of Service

PART I: INTRODUCTION

1.1 The mission of Ai.Tube is to expand human consciousness by unleashing the creative potential of Artificial Intelligence (hereinafter referred to as AI). The Service is a platform that exclusively demonstrates, sells, downloads, and discusses Content synthesized based on AI models. Currently, the Ai.Tube Service presents Content of the following types: Video Collections and Arts, Image Collections and Arts, Audio Collections and Arts, Text Collections and Arts. 1.2 These Terms of Service (hereinafter referred to as "Terms") govern the relationship between the Ai.Tube Service (hereinafter referred to as "Service") and the Users of the Service. The Terms of Service are published on this page: Ai.tube/terms. 1.3 By registering and using the Service, the User expresses their agreement with the Terms of this Service. If the User does not agree with the Terms of Service, they do not have the right to register and use the services of the Service. 1.4 The Service reserves the right to change the content of these Terms of Service at any time without special notification. The new version of the Terms of Service comes into effect from the moment of its placement on this page of the website, unless otherwise provided by the new version of the Terms of Service.

PART II: TERMS AND DEFINITIONS

2.1 Real Human – a real, existing, living (or having lived in the past) biological being in our dimension, belonging to the species Homo sapiens, possessing a developed brain that supports a high level of cognitive functions, such as consciousness, thinking, emotions, imagination, creativity, ability to learn and make decisions. 2.2 Artificial Intelligence (Generative artificial intelligence, hereinafter AI) – a computer program, pre-programmed with algorithms, which has been trained on a large mass of data (images), and which can synthesize new original images (video, pictures, audio, texts) based on this database. 2.3 Image of a real Human – a visual or audio image (voice) of a person that was synthesized by AI based on the images (appearance, voice) of one specific Real Human. 2.4 Image of a synthetic Human – a visual or audio image (voice) of a person that was synthesized by AI based on multiple images (appearances, voices) of multiple Real people; it resembles each of the used images, but is not any of them. The image of a synthetic Human is an image of a person who does not (and never did) exist in reality. 2.5 User – a Real Human who has carefully read these Terms of Service from beginning to end, understood them, and, having agreed to comply with all Terms of Service, has registered on the Service for the purpose of using the Services of the Service. 2.6 Collection Creator – a User who, using their skills and abilities, with the help of original prompts and AI settings they invented, created original synthetic Content and uploaded it to the Service. 2.7 Collection Owner – a User who owns the Collection uploaded to the Service. 2.8 Administrator – a Human who monitors Users' compliance with the Terms of Service and is also empowered to perform administrative procedures in relation to other Users. 2.9 Moderator – an Administrator who decides on the admission of an uploaded Collection for publication on the Service. 2.10 Art – The basic unit of Content, a separately taken synthetic work of art (one video, one image, one audio, one text). 2.11 Collection – An indivisible Collection consisting of Arts (a Collection can have from 1 to 128 Arts). 2.12 Content – The totality of all types of Collections: Video, Images, Audio, Text. 2.13 Content 18+ – Visual Content that contains exposed female breasts with nipples, female or male genitals; audio or text content that contains descriptions of erotic scenes. 2.14 Series of Collections – A thematic and conditional grouping of Collections, which is set by the Collection Owner in their public profile with Collections to simplify navigation through the Content. 2.15 Collection Rating – A public profitability rating of Collections, the Owner of which does not hide in their profile settings the statistics on income from the monetization of their Collections. 2.16 Collection Auction – A public auction where Collection Owners can sell Collections belonging to them. 2.17 User Nickname – The name displayed in the User's profile. The User can choose a free, available name consisting of 7 or more characters in their personal account. If the User wants to take a shorter name, this can be done for money: 6 characters for $64; 5 characters for $512; 4 characters for $14,096; 3 characters for $ 32,768; 2 and 1 character - cannot be created and used.

PART III: USER CAPABILITIES

3.1 Users can upload (upload rules for Collections are specified separately in the upload interface), sell, transfer Collections of Arts that have been synthesized based on trained AI models, as well as receive income from placing their Collections on the Service. 3.2 Users can view newly added Collections and search for Collections and Arts by hashtags on the Service's Title page. 3.3 Users can subscribe to Collection Creators they are interested in, compile lists of favorite Users, and follow their updates on the Favorites page. 3.4 Users can view profitability Ratings of individual Collections and Collection Owners who do not hide their income. 3.5 Users can buy Collections from other Users at the Auction, or receive these Collections from them by direct transfer without conducting an Auction. 3.6 Users can Like Collections or individual Arts they like, independently determining the cost of the Like. 3.7 Users can download Collections or individual Arts in good quality for personal use (without obtaining ownership rights to these Collections). 3.8 Users can comment on Collections and Arts of other Users. 3.9 Users can file complaints about Collections that, in their opinion, violate the Terms of Content placement on the Service. 3.10 Users can expect that each submitted complaint will be carefully reviewed by the Service Administrator, and a decision will be made within 48 hours from the moment the complaint is filed. 3.11 Users can contact the Service support to receive prompt assistance from the Service Administrator. To do this, the User must create a Help Ticket in the Help section and specify the topic of the request. The Service administration undertakes to respond to each request within 48 hours from the moment the Help Ticket is created. 3.12 Each user has the opportunity to find like-minded people on the Service, interesting people who are passionate about the possibilities of AI to synthesize Content that goes beyond human abilities to create works of Art. 3.13 When communicating with other Users, the User can expect a friendly, reasonable attitude towards themselves and their Collections from other Users of the Service. Each User who conscientiously complies with these Terms of Service has the right to expect that other Users also comply with these Terms of Service. The Service Administration, for its part, undertakes to protect the rights and interests of conscientious Users, and in case of considering conflicts between Users of the Service, undertakes to make impartial, balanced and logical decisions, taking into account all possible circumstances of the conflict that has arisen between Users. 3.14 Users have the ability to replenish their account balance and withdraw money from the balance using USDT stablecoins. 3.15 Users have the ability to make internal money transfers to other Users of the Service. 3.16 Users have the ability to hide or keep public statistical data on the profitability of all their Collections. In the case when a User hides income from their Collections, they are not displayed in the Collection profitability Ratings, the Owner himself is also excluded from the Collection Owners' income rating. 3.17 Users who have reached the age of 18 can view Content intended for an audience of 18+, as well as have the ability to opt out of viewing Content with such marking in their profile settings.

PART IV: WHAT IS PROHIBITED AND ALLOWED

4.1 On the Service it is prohibited to: 4.1.1 Upload videos, pictures, recorded sounds, or texts written by humans in the real world. The User undertakes to upload Content synthesized only with the help of AI. Minor processing in editors is allowed to improve the quality of the Content. 4.1.2 Upload visual Content with overlaid watermarks, logos, inscriptions, including semi-transparent inscriptions or drawings (except for cases when such inscriptions or drawings are part of an artistic solution). 4.1.3 Upload Content that violates the rights of third parties. 4.1.4 Upload Content that has already been uploaded to the Service or Content that is similar to the point of recognizability (similarity) to the Content that has already been uploaded to the Service. The uploaded Collection should not explicitly copy, imitate, or try to be similar to another Collection already published on the Service. 4.1.5 Upload Content that contains photorealistic Images of Real People if such videos, audio, images can be perceived as documentary, that is, actually made (shot, recorded) in the real world, in a real life situation. Photorealistic Images of Real People are allowed, provided that such videos, images or audio in style and essence of content are clearly artistic fiction. At the same time, such videos, images or audio should not be humiliating or offensive to those Real People whose Images are used. 4.1.6 Upload shocking Content that may cause disgust in other Users. Such Content includes: scenes of disgusting, cruel violence against people or animals, hard violence, dismembered human bodies, etc. It is allowed to depict bruises, contusions, deep wounds, blood on the human body, provided that these elements are only part of the artistic plot, and not an end in themselves to shock the viewer. 4.1.7 Upload Content 18+ with the Image of a Real or Synthetic Person whose adulthood is not obvious by external signs, and can be equated to child erotica (even if the Real person whose image is taken as the basis for the Synthetic Person has reached adulthood). Placing such Content leads to immediate blocking of the User's account. 4.1.8 Upload Content 18+ with Images of Real People, even if their adulthood is obvious by external signs, without appropriate permission from this Real Person and without such Real Person reaching adulthood in accordance with the jurisdiction to which this Real Person belongs. 4.1.9 Upload Content depicting scenes of sexual intercourse. 4.1.10 Upload Content that aims to offend, humiliate the depicted person on the basis of religious, party, national, gender and other affiliations. 4.1.11 Upload Content that aims to advertise anything. It is also prohibited to use actually registered logos of real existing brands, except for cases when such use is of a one-time nature and is an integral part of the artistic plot. 4.1.12 Use rude profanity in the name of the Collection or individual Arts, or use such names that may mislead Users regarding the real content of Collections or Arts. 4.1.13 Use rude profanity as hashtags for Collections or individual Arts, or use such hashtags that may mislead Users regarding the real content of Collections or Arts. 4.1.14 Upload malicious code to the Service. 4.1.15 Hack the Service's servers, try to guess passwords from other accounts, log into other people's accounts and perform any actions on someone else's account. 4.1.16 Send SPAM (including advertising messages) through personal messages or in comments to Arts and Collections of other Users. 4.1.17 Insult and humiliate other Users of the Service in private correspondence or in comments to Arts and Collections. 4.1.18 In any way massively collect personal information about Users and use it in any way. 4.1.19 Lie, cheat, mislead other Users, Administrators and Moderators of the Service. 4.2 On the Service it is allowed: 4.2.1 Everything that is not prohibited in paragraphs 4.1.1 – 4.1.19. 4.3 The Service reserves the right to supplement the list of prohibitions and restrictions at any time. The changes made come into effect immediately and right after publication. Such changes may have retroactive effect and Collections previously uploaded to the Service may be deleted in accordance with the new Terms of Service. In case of violation of the established prohibitions, sanctions may be applied to the User according to PART IV of these Terms. 4.4 The Service operates under the rule of pre-moderation of collections. This means that any uploaded collection is moderated before publication. At the same time, the moderator has the right to: - add the collection for publication on the site in the form in which it was uploaded; - add the collection for publication on the site after removing some arts that, in their opinion, do not meet the requirements for acceptable content. - reject the collection with an explanation of the reasons for refusal or without explanation of reasons. 4.4.1 Any decision of the moderator is final and not subject to appeal.

PART V. CONTENT OWNERSHIP RIGHTS

5.1 The User (in relation to the Content they upload to the Service) must use AI models for Content synthesis that: 5.1.1 Did not violate copyrights on the Content used for training during the training process; 5.1.2 In turn, allow the User of the AI model to use the resulting synthesized Content for their purposes. 5.2 The Content uploaded to the Service must be clean in terms of intellectual property rights; and the only right that arose in the process of Content synthesis (which arises due to author's prompting, model configuration, and possible processing in relevant editors) should belong exclusively to the Content Creator. 5.3 By uploading Content to the Service, the Content Creator assumes all possible responsibility for any claims from third parties regarding the final result of Content synthesis (including, but not limited to: claims from AI model developers, claims from authors of Content based on which AI models were trained, claims from a Real Person whose image was used without their consent, other claims from third parties). 5.4 WHEN UPLOADING COLLECTIONS TO THE SERVICE, THE COLLECTION CREATOR DOES NOT TRANSFER OWNERSHIP RIGHTS OF THE UPLOADED COLLECTION TO THE SERVICE. However, the Collection Creator gives the Service the right to: 5.4.1 Display their Collection publicly on the website; 5.4.2 Use the Service's technical means to assist in implementing ways to monetize the Collection: through Likes (donations) from other Users, through payment for downloading the Collection in good quality, through selling Collections at the Service's Auction. The Collection Owner agrees to the following income distribution ratio resulting from the Collection's monetization: 90% is received by the Collection Owner, 10% is the Service's service fee. 5.5 THE COLLECTION CREATOR, WHEN SELLING THE COLLECTION AT THE SERVICE'S AUCTION OR THROUGH TRANSFER TO ANOTHER USER, AUTOMATICALLY TRANSFERS THE INTELLECTUAL PROPERTY RIGHTS TO THE NEW OWNER WITH ALL ENSUING CONSEQUENCES. 5.5.1 The current Collection Owner, as well as the history of ownership transfer of the Collection, is public information and can be seen in the additional options of each Collection presented on the website. 5.6 WE DO NOT GUARANTEE THAT ALL COLLECTIONS UPLOADED TO THE SERVICE ARE CLEAN IN TERMS OF ALL INTELLECTUAL PROPERTY RIGHTS, AT ALL LEVELS OF THE EMERGENCE OF SUCH RIGHTS: FROM THE MOMENT OF THE UNIVERSE'S CREATION TO THE PRESENT MOMENT. Each User, when uploading a Collection, knows that they can only upload Content that they synthesized independently without violating third-party rights, however, we cannot always ensure that all Users always comply with this clause of the Terms of Service (also, the Collection Creators themselves cannot always be fully sure that by synthesizing Content, they are not violating anyone's rights). By acquiring ownership of a Collection, YOU ASSUME ALL RISKS. If at some point it turns out, and is proven in court, that the Collection you acquired violates the rights of third parties, such a Collection will be removed from the Service regardless of who owns it and without any compensation from the Service to its current Owner. We bear no responsibility to you in this case; including no responsibility for lost profits, expenses for acquiring the Collection, or any other possible incidental losses. 5.7 The Service provides the possibility to file a complaint about a Collection if you believe that the placement of this Collection on the Service clearly violates someone's rights. The burden of proof of violations lies directly on the complainant. When filing a complaint, easily verifiable evidence should be provided, such as earlier publications of the Collection either on the Service itself or on another trustworthy website. 5.8 The Administration makes a decision to remove Collections from the Service due to copyright violations on the Collection only if such violation is obvious to the Service Administration. Otherwise, the claim must be taken to court. 5.9 Any Collection uploaded to the Service may be removed from the Service by the Service Administration without explanation and WITHOUT ANY COMPENSATION TO EITHER THE COLLECTION CREATOR OR THE CURRENT OWNER. 5.10 Regarding any other content (User comments, their avatar, profile album cover, etc.), the User grants the Service an exclusive, perpetual, free, gratuitous, non-transferable right to use, copy, store, display, publish, broadcast, transmit, distribute, modify this content on the Service, or in any media or through any technologies known at the moment or those that may be developed in the future. 5.11 A User who downloads a Collection or Art in good quality receives a non-transferable right to use, copy, store, display, publish, broadcast, transmit, distribute, modify and create derivative works from the downloaded Collections or Arts. However, the User does not acquire ownership rights to these Collections or Arts and does not have the right to resell them, rent them out, or otherwise derive income from the direct commercial realization of these Collections or Arts.

PART VI. AUCTION RULES

6.1 When uploading Collections to the Service, the User can specify the minimum bid (cost) for selling the Collection at the Auction. If the User does not want to sell the Collection at the auction, they have the right to set the cost value to 0. In this case, the Collection cannot participate in the Auction. 6.2 To start bidding for a Collection, the User's balance must have sufficient funds to pay the minimum bid set by the Collection Owner. If there are sufficient funds, the User can start bidding, and the minimum bid amount is blocked on the account of the User starting the Auction. 6.3 Each subsequent bid must be at least 5% higher than the previous bid. If a second User outbids the first User, the amount paid by the first User for the first (minimum) bid is unfrozen on their account, and so on. 6.4 Bidding at the Auction lasts for 48 hours from the moment the first bid is paid, but is automatically extended if no more than one hour has passed since the last bid. In this case, the bidding ends one hour after the last bid. 6.5 The User who made the highest bid becomes the winner of the Auction and receives ownership of the Collection (as well as in the case when the Collection was not sold through the Auction, but simply transferred to another User) from this moment: 6.5.1 all intellectual property rights, whatever they may be, are transferred to the new Collection Owner, accordingly, the previous Collection Owner loses these rights; 6.5.2 any income resulting from the monetization of the Collection is credited to the current Collection Owner, consequently, the previous Collection Owner no longer receives income from it; 6.5.3 all Likes that were given to this Collection are summed up with all Likes displayed in the personal profile of the new Collection Owner and subtracted from the sum of likes of the previous Collection Owner. 6.6 The Collection Owner, whose auction has started, cannot cancel the auction or delete the Collection during the Auction. 6.7 Funds received for the sale of the Collection are credited to the seller's balance immediately after the completion of the Auction (according to clause 5.4.2 of the Terms of Service - minus 10% Service fee). 6.8 The daily current income associated with the monetization of the Collection is credited exactly at 00:00 UTC to its current Owner. 6.9 The Ai.Tube Service is not a tax agent in any jurisdiction, does not withhold or pay taxes for Users. The User must resolve the taxation issue independently. By using this Service, the User confirms that, in accordance with the jurisdiction to which they belong, the activity of receiving income from the monetization of Collections created by them does not contradict local legislation.

PART VII: USER RESPONSIBILITY

7.1 A User who violates these Terms of Service (violates the prohibitions described in PART IV of these Terms of Use) may be blocked by decision of the Service Administration. 7.2 User blocking can be temporary: for 72 hours, for 1 week, for 1 month, or permanent (User is blocked forever). 7.3 A blocked User can log in to the Service, but at the same time: 7.3.1 Cannot receive daily income from their Collections; 7.3.2 Cannot upload new Collections to the Service; 7.3.3 Cannot manage their Collections, including buying them at auction, sending their Collections to other Users, receiving Collections from other Users; 7.3.4 Cannot start an auction (while current auctions for collections in their ownership continue and the money received for the sale of the collection is credited to the user's account). 7.3.5 Cannot like, write comments, or send messages to other Users, including starting new conversations. 7.4 After the blocking period expires, all functions of the User's account are unblocked, however, the lost income from the monetization of the User's Collections during the blocking period is not compensated (lost income is a form of punishment for violating the Terms of Service). 7.5 In case of minor and insignificant violations, the Administrator may issue a warning to the User without setting a blocking period for the User's account. However, repeated or multiple violations of the Terms of Service entail a longer blocking period, up to permanent blocking, without the possibility of restoration. 7.6 The form of punishment and the blocking period are determined by the Administrator independently, at their discretion, based on specific violations of the Terms of Service, as well as taking into account all available information about the User (history of their previous violations of the Terms of Service, duration and volume of conscientious use of the Service, etc.). The Administrator's decision is not subject to appeal.

PART VIII: SERVICE RESPONSIBILITY

8.1 The Service is not responsible for the actions of Users related to the use of the Service and the provided Services. 8.2 The Service undertakes to ensure the proper functioning of the Website and to take all necessary measures to protect the personal data of Users, however, in case of unintentional leaks of personal data, the Service is not responsible for direct or indirect damage that may be associated with such leaks. 8.3 The Service undertakes to ensure proper storage of funds on Users' accounts and to take all necessary measures to protect Users' funds, as well as to persistently urge all Users to observe basic security principles: 8.3.1 Enable and use two-factor authentication (2FA), 8.3.2 Use a unique password for the Service account that is not used on any other sites and does not match the User's email password. 8.3.3 Verify that the URL of the site where they enter their account password is exactly ai.tube, and not some other site. 8.3.4 Under no circumstances disclose their account password to anyone, even those who introduce themselves as Service Administrators. 8.3.5 In case of hacker attacks on the Service, the Service does not bear financial responsibility for direct or indirect damage that may be caused by such an attack. 8.4 The Service Administration works diligently with full dedication on the development and improvement of the Service, believes in the bright future of the Service. At the same time, due to uncertainty in national and international jurisdictions regarding Content synthesized based on AI models, the Service Administration may be forced at any time to significantly change the Terms of Service provision in individual jurisdictions or worldwide. In this case, the functionality and Terms of Service provision may be significantly changed, up to unrecognizability. The Service operation may be terminated in individual jurisdictions or worldwide. 8.5 The Service Administration presents the Service "as is" with all its obvious and/or hidden defects. At the same time, if a User notices any bugs or deficiencies in the Service, they can use the Help Ticket to notify the Service administration about this. The Service administration should also be notified if a significant security vulnerability in the Service is discovered. The Service reserves the right to pay a commensurate reward for a found vulnerability.

PART IX: SERVICE FEES

9. Currently, the following service fees are in effect: 9.1 Service fee of 10% from income from collection monetization (likes, downloads); 9.2 Service fee of 10% from the transaction amount at the auction (charged from the seller); 9.3 Service fee of 2% when withdrawing stablecoins other than USDM from the user's account.

PART X: PLACEMENT OF COLLECTION ADVERTISEMENTS

10.1 Collection ads start showing at 00:00 UTC (Coordinated Universal Time). 10.2 You have the option to cancel the ads at any time. If you cancel, you will be refunded your money, but with a deduction of fees for the day of advertising that has already passed and started. If you cancel an advertisement before it starts, you will receive a full refund. 10.3 Your budget is evenly distributed throughout the advertisement period. For example, if you allocate $100 for 10 days, $10 will be spent each day. 10.4 You do not pay for clicks, but for a share in the total advertising pool. Your share is directly proportional to your budget. If in the general pool for the day placed ads totaling $1000 and your daily budget of $10, then your share of the total pool will be 1%. The number of clicks depends on the attractiveness of your collection cover and how often your ads are shown. 10.5 The frequency of your ad displays depends on your share of the ad pool each day. The larger your share, the more often your ads appear. That is, if your share of the total pool is 1%, your ad will show up once in every hundred ad displays. 10.6 Since the total amount of the advertising pool changes every day (other advertisers add or remove their ads), your share and, consequently, the frequency of impressions varies from day to day, while your daily budget remains the same. 10.7 If the collection changes ownership (auction sale, transfer) or is deleted, the ads are automatically deleted as a general rule (item 2). 10.8 Statistics show data for today and for all time: CPC - Cost per click, average for today. C - Clicks (not unique) on your ad, for today. SAP - Your share in the total advertising pool, for today. CPCT - Cost per click, average for all days. CT - Total clicks, for all days. SAPT - Your share in the total advertising pool, average for all days.

PART XI: TERMS VERSION
